The Capillus Trade-In Program ("Program") is a limited promotional incentive operated by Capillus, LLC ("Capillus," "we," "us"). By enrolling, you ("Participant," "you") agree to all terms below. These terms form a binding agreement.

Section 2

Eligibility

2.1 — Who Can Participate

Participation is open to individuals who are the lawful owner of the device submitted. By enrolling, you represent and warrant that you own the submitted device free of any liens, encumbrances, or third-party claims, and that you have full authority to transfer ownership to Capillus.

2.2 — Qualifying Devices

Capillus accepts laser and LED hair restoration devices manufactured under the Capillus brand. The submitted device must:

  • Match the exact make and model declared at enrollment, verified against enrollment photos
  • Include all major original components in substantially complete condition
  • Not be a counterfeit, replica, or previously traded-in device
  • Show no evidence of deliberate destruction or intentional damage

Photos are required at enrollment. Physical inspection on arrival is final. Capillus reserves the right to decline any device at its sole discretion.

Section 3

Shipping Process

Capillus controls the entire inbound shipping process. You must use the prepaid UPS label generated inside the Capillus Trade-In Portal. Use of any other carrier, service, or label immediately voids all program rights.

  • Carrier: UPS only. Any other carrier voids the submission and all program rights.
  • Label source: Capillus Trade-In Portal. One label issued per enrollment.
  • Cost: Capillus pays for all outbound trade-in shipping labels.
  • Drop-off: Customer drops off at any authorized UPS location. Capillus does not schedule a UPS pick-up.
  • Label validity: Must be used within 14 calendar days of enrollment confirmation. Expired labels void the submission.
  • Drop-off receipt: Customer must retain the UPS drop-off receipt. This is your only proof of tender. Loss of this receipt limits your ability to pursue any lost-shipment claim.
  • Label misuse: The label is single-use and linked to the specific enrollment. Using it for any other shipment constitutes fraud (see Section 9).
  • Packaging: Customer is fully responsible for adequately packaging the device, regardless of who pays for the shipping label.

Section 4

Inspection, Verification & Assessment

Every package is opened and documented with photos and timestamps. The submitted device is compared against the enrollment declaration and enrollment photos. Inspection is completed within 10 business days of receipt.

4.1 — Standard Flow

  • All packages photographed on receipt
  • Inspection completed within 10 business days of receipt
  • Device compared against enrollment declaration and photos
  • If device passes: Trade-In Credit issued within 5 business days of inspection completion

4.2 — Wrong Device Submitted

The device received does not match the make and model declared at enrollment — for example, a generic or lower-value device was shipped in place of a declared premium Capillus cap.
  • Capillus notifies you within 5 business days of discovering the discrepancy
  • You have 5 business days to respond: (A) accept a revised credit for the actual device received — which may be $0 — or (B) request the device returned at your own shipping expense
  • No response within 5 days: Capillus may dispose of, donate, or recycle the device. No credit will be issued.
  • Capillus is not liable for your time, original shipping costs, or any consequential losses

4.3 — Empty Box or Non-Device Items Submitted

Fraud — Strongest Enforcement Applies: Submitting an empty box, non-device items (rocks, household objects, unrelated products), or any shipment containing no qualifying device.
  • Package is photographed with timestamp immediately upon opening
  • Trade-In Credit is void. No appeal.
  • Customer is notified within 5 business days
  • Documentation retained for a minimum of 12 months
  • Capillus reserves the right to report the incident to law enforcement and pursue civil remedies for all resulting damages
  • Participant is permanently banned from all Capillus programs, past and future

4.4 — Device Arrives Damaged

The submitted device arrives damaged — either due to inadequate packaging by the customer, or potential mishandling by UPS in transit.
  • Capillus assesses cause: carrier mishandling vs. inadequate customer packaging
  • Inadequate packaging (customer fault): Capillus may reduce or void credit at its sole discretion
  • Carrier damage: Capillus files a UPS claim. Credit decision is held pending claim outcome.
  • Packaging is always the customer's responsibility — regardless of who provided or paid for the shipping label

Section 5

Lost or Undelivered Shipments

Because Capillus provides the UPS label and is the shipper of record, risk allocation is as follows:

  • Before UPS drop-off scan: Risk is entirely the customer's
  • After a valid UPS drop-off scan: Capillus files the carrier claim
  • No Trade-In Credit is issued until the device is physically received and inspected
  • Exception: If a UPS claim is resolved in Capillus's favor and enrollment documentation supports the declared device, Capillus may honor the credit at its sole discretion. This is not an obligation.
  • Missing shipments must be reported within 60 days of label issuance
  • Drop-off receipt required: No receipt = no claim support from Capillus.
  • Capillus's maximum liability for any lost shipment is the face value of the applicable Trade-In Credit. Nothing more.

Section 6

Trade-In Credit & Discount Code Rules

The Trade-In Credit is a single-use Shopify discount code emailed to the address used at enrollment. It is not cash and carries no monetary value outside capillus.com. All credit decisions are final.

  • Redeemable exclusively at capillus.com
  • Minimum order value: $1,000 USD before tax and shipping
  • Expires 90 days from issuance. No extensions. No reissuance after expiry.
  • Stackable with ONE other promotional code only
  • Cannot be combined with: employee discounts, clinical or partner discounts, pre-discounted bundles, or any code marked "exclusive" or "non-combinable"
  • Non-transferable. Cannot be sold, assigned, gifted, or bartered.
  • No cash value. Cannot be exchanged for gift cards, store credit, or any monetary equivalent.
  • One code per order. Cannot be applied retroactively to completed orders.
  • If a stacked combination creates an invalid or zero-value order, Capillus may reject it and require resubmission

Section 7

Returns & Refunds on Trade-In Orders

  • If an order placed using a Trade-In Credit is subsequently returned, the Trade-In Credit value is deducted from any refund amount
  • The Trade-In Credit code is consumed upon use and is not reinstated after a return, regardless of the outcome
  • The submitted trade-in device is not returned under any circumstances once a credit has been issued
  • Standard Capillus return policy applies to the remaining order value

Section 8

Device Ownership After Submission

  • All submitted devices become Capillus property upon physical receipt at our facility
  • Capillus may refurbish, recycle, donate, resell, or destroy submitted devices at its sole discretion
  • Capillus will not return devices except in the wrong-device scenario described in Section 4.2, and only at the customer's shipping expense
  • Personal data: You are solely responsible for removing all personal data before shipping. Capillus accepts no responsibility for any personal data found on submitted devices.

Section 9

Fraud Prevention & Program Abuse

The following constitute prohibited acts under these Terms and void all program rights immediately upon discovery:

  • Submitting an empty box or non-device items
  • Misrepresenting the make, model, or condition of a submitted device
  • Misuse of the Capillus-issued UPS label for any shipment other than the enrolled device
  • Creating multiple accounts or enrollments to obtain multiple Trade-In Credits
  • Reselling, transferring, or brokering Trade-In Credit codes
  • Any act of deception, misrepresentation, or bad faith in connection with this Program

Upon discovery of any prohibited act, Capillus may: permanently ban the participant from all current and future Capillus programs; report the incident to federal, state, or local law enforcement; and pursue all available civil remedies for damages.


Section 10

Privacy & Personal Data

By enrolling in the Program, you provide personal data including your name, email address, shipping address, and device information. This data is collected and processed in accordance with the Capillus Privacy Policy.

  • Enrollment data is used solely for Program administration, fraud prevention, and — where you have separately opted in — Capillus marketing communications
  • Enrollment does not automatically constitute consent to marketing. That consent is captured separately at enrollment.
  • Enrollment photos are retained for a minimum of 12 months for fraud prevention purposes
  • You may request deletion of your personal data, subject to retention obligations required by law or legitimate business interest (including fraud documentation)
  • Capillus uses Shopify as its ecommerce platform. Shopify's data practices apply to transaction data. Refer to Shopify's Privacy Policy for details.

Section 11

Tax Treatment

The Trade-In Credit is a promotional discount applied at checkout and does not constitute income. However:

  • Capillus makes no representation regarding the tax treatment of Trade-In Credits in your jurisdiction
  • Sales tax on the new device purchase is calculated on the pre-discount order total, unless applicable law requires otherwise. Actual tax treatment may vary by state.
  • Participants are solely responsible for any tax obligations arising from participation in this Program
  • Capillus recommends consulting a qualified tax advisor if you have questions about how a promotional discount affects your tax position

Section 12

Program Modifications & Termination

  • Capillus reserves the right to modify, suspend, or terminate the Program at any time, with or without notice, at its sole discretion
  • Credits already issued and not yet expired at the time of Program termination will be honored for their remaining validity period, unless prohibited by fraud or breach of these Terms
  • Credit values and eligible device models may change at any time. The credit value applicable to your submission is the value in effect at the time of enrollment confirmation, not at any later date.
  • These Terms may be updated. The version in effect at the time of your enrollment governs your submission. Material changes will be posted at this URL with an updated effective date.

Section 13

Disputes & Governing Law

  • These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles
  • Any dispute arising out of or relating to this Program shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules
  • Class action waiver: You agree to resolve any dispute individually and waive any right to participate in a class action, class arbitration, or representative proceeding
  • Small claims court remains available for disputes within its jurisdictional threshold
  • Capillus's total liability arising out of or related to this Program shall not exceed the face value of the applicable Trade-In Credit
